Limitation of Liability
Please be aware that all products purchased from us are to be used at your own risk. In no event shall Telespace be liable for the following:
- Any claims, damages, losses, or injuries arising from the use of our products. This includes third party claims, loss or damage to records, data, or hardware/equipment, economic consequential damages, incidental damages, or any other consequential damages.
- Telespace’s liability is limited to the cost of the purchased product, and any risk associated with the use of the product rests solely with the customer.
- Once goods are shipped, the responsibility for the goods transfers to the customer, who has consumer rights regarding the delivery by the carrier.
Warranty
Please note that this warranty information provided by Telespace is important for customers to understand their rights and responsibilities when purchasing products from Telespace.
- The warranty covers manufacturer defects for a period of 12 months from the date of receipt or invoice, but only for the original purchaser. Consumables are not covered under this warranty, unless a defect is found.
- However, it is important to understand that the warranty does not apply to any item that has been modified, overclocked, abused, or misused.
- Additionally, Teespace does not provide warranty for compatibility issues with customers’ current components. It is the responsibility of the customer to ensure compatibility before purchasing (e.g., choosing the correct heatsink for CPU).
- If a customer needs to return a product under warranty, they are solely responsible for shipping the product back to Telespace using a reputable carrier that can provide proof of delivery and insurance for the entire value of the shipment.
- The customer is also responsible for all shipping charges and bears the risk of loss or damages during transit.
- When returning a product, the customer should include their original invoice number, contact details, a description of the problem, and any other relevant information. It is important to adequately pack the product for shipment, as Telespace will reject any package that is poorly packaged or sent only in the original retail box. The customer will be held responsible for any damage caused during shipping due to poor packaging.
- In cases of returns for refunds or credits, a copy of the original receipt must be included. It is also worth noting that the Australian Consumer Law (ACL) protects consumers by providing certain guaranteed rights. These rights, known as Consumer Guarantees, ensure that goods are free of defects and perform as intended, while services are carried out with care and skill. These guarantees apply automatically and cannot be excluded.
- Accordingly, customers have the right to a replacement, refund, or compensation for any reasonably foreseeable loss or damage in case of a major failure. If the goods fail to be of acceptable quality and do not amount to a major failure, the customer is entitled to have the goods repaired or replaced. Consumer Guarantees have no set time limit and may continue to apply after the manufacturer’s warranty has expired, depending on the price and quality of the goods.
Change of mind returns
- Customers can receive a complete refund for non-defective items if they return it to Telespace within 03 days, during the change-of-mind period. To be eligible for the refund, the product must be in its original undamaged packaging, in “as new” condition, and unopened if sealed by the manufacturer. Please note that shipping charges will not be refunded. The refund amount will be based on the lower value between the currently listed price on our website or the invoice.
- The customer bears full responsibility for shipping any returned product back to Telespace. Additionally, customers must use a reputable carrier that can provide proof of delivery and insurance for the entire value of the shipment. In doing so, the customer agrees to bear all costs of shipping charges as well as assume all risks of loss during transit to Telespace. It is also expected that the returned product will be in 100% complete and re-saleable condition, including the original packaging, manuals, and any other accompanying materials.
- If you decide to return an item that you bought from Telespace and it is no longer in “as new” condition (e.g., packaging has been opened, seals broken, or any other difference from an unsold product), or if it is outside the allowable change of mind period, Telespace might still offer you a refund. However, a restocking fee of 15% will be deducted, and your refund will be calculated based on the lower value between the current retail price and the price you initially paid.
- Please note that Telespace reserves the right to refuse returns for change of mind on certain products. This includes items that are not considered new, such as clearance items, special order or back-to-back items. Additionally, products with activated software, personal items like headphones that cannot be resold due to hygiene concerns, or items that are unsaleable due to age, obsolescence, damage in transit, or physical imperfections may also be rejected for return.
If the manufacturer or distributor approves the return of special-order items, back-to-back items, or items ordered specifically for the customer, Telespace will then provide a refund.
Shortages
Customer has to Inspect shipment upon receipt and report shortages within fourteen (14) days. No responsibility or options will be offered by Telespace after fourteen (14) days .
Damage in transit
- It is important that customer or recipient thoroughly examine the contents of your shipment as soon as you receive it. You are given a period of fourteen (14) days from the confirmed delivery date to report any damaged or broken items that may have occurred during transit. Beyond this timeframe, we regret to inform you that we cannot assume any responsibility or provide any alternatives or solutions.
- If there is any damage to the packaging of the delivered order and wish to file a claim for damage or breakage during transit, customer will need to provide photos and/or videos of both the damaged packaging and the product itself. It is important to document any signs of damage to the package before opening it.
- Contact Telespace immediately so Telespace can assist in filing a claim with the shipping carrier. It is important to keep all original packaging and documents for the claim process. Failure to report any damages within the specified timeframe may result in denial of the claim and Telespace will not be able to offer any compensation or solutions.
